Presentation

This class aims to provide students with an understanding of the institutional system of the European Union. It will begin with a review of the evolution of the European Communities and the European Union since 1951, before examining the main characteristics and major challenges facing the Union.

In the first part of this course, we will examine the main institutions of the Union from both a "static" (organization and functioning) and a "dynamic" point of view (allocation of powers, decision-making mechanisms, etc.).

In the second part, we will study the legal order of the European Union: What are the sources of EU law? Its effects (primacy, direct effect)?  And how do Member States respond to those constraints?

In the final part of the course we will focus our attention on the Union’s litigation system, and will examine the various legal remedies available to the Court of Justice of the European Union to ensure the uniform application of Community law throughout the Union (contentious appeal, preliminary ruling)

Recommended Prerequisite(s)

A good knowledge of the main European organizations, and particularly of the Council of Europe and the European convention on Human Rights, so as to, among other things, avoid semantic confusion.

Form of assessment

The number of ECTS credits and the assessment methods are likely to be different for students in credit exchange programmes.

Educational formula

Students are required to have a minimum level of knowledge, in particular, of decision-making processes, of standards and their effects, and of the case law of the Court of Justice of the European Union.
